Peter Sanderson

Senior Litigation Counsel

Peter is one of the most active litigators before the Bermuda courts, and is familiar with applying for interim injunctions and stays of proceedings at short notice. He appears regularly before the Supreme Court, Court of Appeal, and specialist tribunals, and has also appeared before the Privy Council in London. He adds value for clients through a dynamic approach of finding angles that others may have missed, in-depth understanding of the sometimes obscure sources underpinning Bermuda’s laws, and a strategic focus on procedural rules and costs mitigation. With this approach, he has been able to build a client base across various areas of law, and has been involved with landmark precedents for the interpretation of the law, reported in international publications such as Law Reports of the Commonwealth and West Indian Reports. Peter has recently advised in the following areas:

•  Civil recovery and proceeds of crime;
•  Maritime, shipping, law of the sea;
•  Territorial limits and extra-territorial issues;
•  Immigration and nationality;
•  Contract and employment disputes;
•  Corporate and shareholder disputes;
•  Trust and probate matters;
•  Disciplinary proceedings and professional negligence;
•  Criminal liability and traffic offences;
•  Child protection matters;
•  Sports law;
•  Property disputes, boundaries and easements;
•  Judicial review of government decisions;
•  Constitutional challenges to legislation;
•  Discrimination and human rights;
•  Insurance liability and personal injuries;

Peter has been appointed as an arbitrator or mediator in various matters. He has sat on a panel tasked to hear a major dispute between the Bermuda government and unions for the entire public service. He has been instructed to provide expert evidence of Bermuda law for foreign proceedings. He is available to act as an Examiner for the taking of depositions.
